2. HOW TO ORDER
a. After consulting the website www.saboresmonasticos.pt, you should choose the products you like best and order them at any time through the online store; from the email geral@saboresmonasticos.pt or by telephone, 918 759 528.
b. Sabores Monásticos considers the order to be completed as soon as payment is confirmed through the bank, provided that the customer sends the proof to the email geral@saboresmonasticos.pt;
c. For the purposes of order confirmation, Sabores Monásticos considers the date and time shown in the payment bank transaction.
3. PRICES
a. The prices shown on the website include VAT at the legal rate in force at the time of purchase, plus the respective shipping costs;
b. The price of the products, the VAT amount and the shipping costs are all duly itemized before the final validation phase of the purchase.

5. DELIVERIES
a. In the Greater Porto region (Porto, Vila Nova de Gaia, Maia, Matosinhos, Gondomar and Valongo) orders are delivered free of charge, whenever the value is equal to or greater than €15, within 48 hours after payment confirmation (2. c);
b. In the remaining areas of mainland Portugal, orders are delivered within two working days, as per CTT rules or by express carrier.

6. CANCELLATION/RETURN
a. The delivery of purchased products respects the legal rules applicable in Portugal to distance commerce (Decree-Law no. 24/2014 of 7 February);
b. Considering the type of products, Sabores Monásticos considers that the customer has the right to claim any defect, inaccuracy or inadequacy of the product at the time of delivery of the order;
c. The cancellation of the order is considered to have been made within 24 hours, from the date and time stated in the bank payment transaction, as stipulated in point 2. b.;
d. Whenever there is a return, under the terms of point b), Sabores Monásticos will refund the customer for the full amount of the order or replace the products with others of equal value, except for shipping costs.
7. PRIVACY AND SECURITY POLICY
a. Sabores Monásticos collects customer data in order to carry out the invoicing procedures;
b. All data collected in paragraph a) will not be transferred to third parties.

a. This agreement is subject to Portuguese law;

8 – Right to data deletion (“right to be forgotten”)
The holder of personal data has the right to ask Sabores Monásticos to delete their data, without undue delay, and Sabores Monásticos has the obligation to delete personal data when, namely, one of the following reasons applies:
a) Personal data are no longer necessary for the purpose for which they were collected or processed;
b) The data subject has withdrawn his consent to the processing of data (in cases where the processing is based on consent) and there is no other basis for such processing;
c) The holder is opposed to the processing and there are no prevailing legitimate interests that justify the processing;
9 – Right to treatment limitation
The data subject has the right to obtain from Sabores Monásticos the processing limitation, if one of the following situations applies:
a) Dispute the accuracy of personal data, for a period that allows Sabores Monásticos to verify their accuracy;
b) The processing of data is lawful and the data subject opposes the deletion of their personal data and requests, in return, the limitation of their use;
c) Sabores Monásticos no longer needs personal data for processing purposes, but these data are required by the holder for the purposes of declaration, exercise or defense of a right in a legal proceeding;
d) If you have opposed the processing, until it is verified that the legitimate reasons of the data controller prevail over those of the data subject.
10 – Data portability right
If the processing depends on the consent of the data subject and this consent has been provided by automated means, the data subject has the right to receive the personal data concerning him/her which he/she has provided to Sabores Monásticos in a structured format, in common use and automatic reading.

Free Right of Termination
RETURN OR FREE CONTRACT RESOLUTION
According to Decree-Law 24/2014 of 14 February – transposition to the Portuguese legal order of Directive no. 2011/83/EU of the European Union – any consumer has the right to freely and without any justification terminate the contract; Sabores Monásticos makes available to its customers the Free Resolution Form Template, as shown in annex B of the aforementioned Decree-Law, in the email confirming the respective request.
PROCEDURE AND DEADLINES
If you wish to terminate the contract, the client must send to Sabores Monásticos the duly completed Free Resolution Form Template or other unequivocal declaration of the intention to terminate the contract, either by electronic means to geral@saboresmonasticos.pt, or by registered letter to to: Sabores Monásticos, Rua de Faria Guimarães nº 7, 4000-206 Porto or through any other durable medium susceptible of proof (the customer being responsible for it), up to a maximum period of 14 (fourteen) days from the date where the customer, or a third party appointed by him other than the carrier, has acquired physical possession of the goods. For this period of free resolution to be respected, it is enough that your communication regarding the exercise of the right of free resolution is sent before the expiry of the period for resolution, after which the return may not be accepted. Sabores Monásticos will acknowledge receipt of the request for termination of the contract within a maximum period of 24 (twenty four) hours, on working days. From the date of communication of the termination of the contract, the customer has up to a maximum of 14 (fourteen) days to send all the items he intends to return to the Sabores Monásticos premises.
EFFECTS
The customer can exercise his right of free resolution in whole or in part and is responsible for the return costs, namely shipping costs, notwithstanding complaints. Sabores Monásticos will reimburse the customer for the payments made, including the cost of delivery of the order (except for additional costs resulting from your choice of a shipping method different from the less expensive normal shipping method offered by us), within a maximum period of 14 (fourteen) days from the date of receipt of the decision to terminate the contract by the customer. Sabores Monásticos reserves the right to retain the refund until receipt and verification of compliance of all returned goods.
In the case of a partial return of the order, the customer will be refunded the value of the items actually returned and the delivery costs, in the amount by which the items in question inflated the cost of shipping costs. This refund will be made through the same payment method used initially by the customer; to reimburse the customer in cases where he chose to pay by ATM or MB Way, Sabores Monásticos will use the following means, in the respective order of preference: PayPal, bank transfer, check not made to order. We may also contact the customer with a view to reimbursement of the amount through a discount voucher to be used at www.saboresmonasticos.pt. Apart from what is mentioned in these Terms and Conditions, the customer does not incur any additional costs as a consequence of such refund.
INSPECTION OF GOODS
As mentioned in the previous point, Sabores Monásticos reserves the right to withhold the refund until it verifies the state of use in which the goods are returned, as this is a vital condition for the refund to be processed. According to paragraph 2 of article 14 of the Decree-Law mentioned in point 4, any article abused and/or manipulated by the client will be considered as non-compliance, following what is described in that point, with particular attention to articles that have own packaging/packaging, which must also be returned in excellent condition and use.
Intellectual and Industrial Property
All of your Sabores Monásticos content is protected under the Intellectual Property Law, in particular copyright and trademarks.
Any use, reproduction or mention of its contents, in whole or in part, is prohibited and constitutes a crime when carried out without the prior authorization of Sabores Monásticos.
The company names, brands and distinctive signs reproduced on the Sabores Monásticos website are protected under the terms of the legal provisions applicable to industrial property. Reproduction or representation of all or part of any distinctive signs is strictly prohibited.
All images and logos of the brands marketed by Sabores Monásticos and reproduced on its online platform are duly authorized by the brands in question. Thus, all the reproduced information and the databases that Sabores Monásticos makes available do not violate the intellectual and industrial property rights of third parties.
